Tesla's lawsuit warning against early resellers of Cybertruck seems to be back again after several people noted the same clause in the order agreement for the limited-edition "Foundation Series."

The same clause threatening to sue owners $50,000 if they resell their electric pickups within the year appeared again when people ordered reservations for the "Foundation Series," ArsTechnica reported.

Several buyers have already pointed out the clause last Friday on a Cybertruck buyers forum.

The lawsuit threat was removed last month from Tesla's Motor Vehicle Order Agreement Terms & Conditions after gaining backlash from the internet and potential buyers.

It is uncertain if the lawsuit clause is only applicable to the limited-edition vehicles. The "Foundation Series" is reportedly only limited to 100 cars at $120,000 each.

Tesla's Policy on Early Resellers

While other car manufacturers have similar policies against early resellers, Tesla went above and threatened its buyers with a lawsuit.

The initial clause states that Cybertruck owners must first offer the car back to Tesla before reselling it within one year of purchase or risk a hefty fine.

The only exception is if the buyer somehow received "written consent" from Tesla.

Auto watchdog Electrek noted that other automakers like Ferrari, Ford, and Porsche used similar clauses for their rare or pricey motors.

Tesla Cybertruck Opens at a Limited Slot

Delayed and overhyped, the EV behemoth received around 1.9 million orders. Buyers also have to pay an additional non-refundable $100 deposit to reserve the car

Tesla CEO Elon Musk has already reported to the company's board that the product will not immediately become Tesla's main moneymaker.

The price of the vehicle has also spiked up from the initial tag when it was introduced in 2019 with the cheapest version sitting at $60,999.

To make matters worse, standard Cybertruck buyers will have to wait next year or until 2025 before receiving their car following production issues in the past three years.
