Pokemon Go Legal Mess: Niantic, Nintendo Faces FEC Complaint

Pokemon Go developer Niantic and Pokemon rights owner Nintendo received more than 70 Federal Trade Commission (FEC) complaints as of September 13. Most of the suits are from players who claimed that they have been deceived by the game developer.

Pokemon Go Players Demand Financial Restitution

Most Pokemon Go players claimed that they have spent a sizeable amount of money playing the game. However, all their efforts and cash were wasted when Niantic permabanned them from the game. They are either demanding reimbursement for all the money they spent on Pokemon Go or removing the ban on their account. Niantic has yet to reply on this matter.

Private Property Owners' Complaint on Pokemon Go

A number of property owners are demanding Niantic to remove the Pokemon Go gyms, Pokestops, Spawn points or nests placed inside their domicile, according to Polygon. Even hospitals are complaining of Pokemon Go players entering patients' room in the search for Pokemon creatures and items. The unwelcome intrusion is seen as a violation of their patient's right to privacy. So far, the Pokemon Go developer has yet to explain its policy of setting up locations in the game.

Pokemon Go Hazardous to Children

Some have complained that Pokemon Go should not be played by children due to public safety. One complainant recounted how he almost ran over a child who did not notice his car because he was engrossed by the Pokemon Go game.

Legal Implications for Pokemon Go

Pokemon Go is still a very popular mobile app game despite the fact that several million players quit the game in recent months. Niantic and Nintendo do not have the same legal headache as the No Man's Sky developer, not yet anyway.

But the companies still have to address the legitimate concerns of the complaints which is child safety and right to privacy and private property.
